STATE ELECTION COMMISSION CONNIVES TO SUPPORT THE CONGRESS

Lok Satta Party had filed a PIL W.P.(C) 382/2013 and subsequent WP 1933/2013 in the Hon’ble High Court against the poll code violations committed by the Congress and BJP candidates and the utter negligence of the authorities concerned especially State Election Commissioner and Delhi police in conducting a free and fair poll.

During the hearings the lawyers appearing for the SEC and Delhi Police hid all facts from the court and failed to inform the court that some FIR’s had been filed on the basis of the complaints of the candidate which constituted violation of model code of conduct. Lawyers appearing for both SEC and Delhi police also hid from the courts that two FIR’s which constituted grave violations of the Model Code of Conduct committed by the Congress Candidate from Preet Vihar had been omitted inspite of proof being provided by the Petitioners which is contempt of court. This is a clear case of supporting the national parties whereas Commission is supposed to be impartial and conduct free and fair elections.

We observe the following:

a)    Complaint dated 12/4/2102 regarding Hoardings on Main Vikas Marg has been completely overlooked by all
b)    Complaint dated 9/4/2012 of benches in parks etc has also been overlooked
c)    Affixing of stickers on public property during elections is not only defacing of public property but also a major violation of model code of conduct – Delhi police has diluted the provisions

The complaints were lodged during elections and we have been given relevant FIR’s after one year which also are incomplete and watered down to help Congress and BJP.

We suggest the commission to direct the Delhi police to file all missing FIR’s for which adequate proof has been submitted to both Commission through the Returning Officer and Delhi Police earlier as mentioned above and also through High Court in the PIL & WP filed.

LSP took a delegation to the State Election Commissioner and handed them a petition but Shri Rakesh Mehta failed to even listen to us and take any action possibly acting on the directions of his bosses in the government.

Lok Satta Party will again file a new Writ Petition claiming contempt of court and misdeclaration by the respondents – State Election Commissioner and Delhi police when the court reopens which will surely make higher officials of both departments cringe in their chair and run to save their posts. This shows brazen nature to defy all rules and regulations.
